Terms of Use

1. General

Welcome to the website of Zimbalista Gallery at zimbalista.com (the “Site”).

The Site is operated by Zimbalista’s Music Factory (Registered Association), Amuta No. 580637940, of 36 Shivat Tsiyon St., Tel Aviv–Yafo (the “Gallery”, “we” or “us”).

These terms of use govern access to and use of the Site. Browsing the Site and using its content constitute acceptance of these terms. If you do not agree to them, please do not use the Site.

These terms are addressed to all genders; references to the singular include the plural and vice versa.

2. Nature of the Site

The Site is an informational website. It presents information about the Gallery, about its exhibition spaces — Zimbalista Gallery and Dov Gallery — and about exhibitions, artists and events, and allows you to contact us through a form.

No online sales take place on the Site, there is no ticket purchasing, and there is no registration or user account. Enquiries regarding the purchase of a work or attendance at an event are handled directly with the Gallery; any such engagement takes place outside the Site and is subject to terms agreed between the parties.

The information on the Site is general and informative in nature. Details of exhibitions, dates, opening hours and the availability of works may change, and we recommend confirming them with us before visiting or making a decision.

3. Permitted use

You may use the Site for personal, non-commercial purposes: viewing and reading content, sharing links to pages of the Site, and contacting us.

You may link to pages of the Site from other websites, provided that the link does not present the Gallery in a misleading manner, does not create an impression of a business relationship or sponsorship that does not exist, and does not display the Site’s content within a frame or in any way that obscures its source.

4. Prohibited use

When using the Site, you must not:

• breach any provision of law or any right of any person or entity;
• take any action intended to disrupt the operation of the Site, overload it or compromise its security;
• attempt to gain access to areas or information that are not open to the public;
• collect information from the Site by automated means (scraping, crawlers and the like) without our written permission;
• copy, reproduce, distribute, transmit, publish, modify or create derivative works from the Site’s content, other than as set out in Section 5;
• make any commercial use of the Site’s content;
• use the contact form to send spam or offensive, threatening or unlawful content.

Breach of these terms entitles us to block access to the Site, at our discretion and without derogating from any other remedy.

5. Intellectual property

Rights in the Site’s content — including texts, design, structure, logo and the Gallery’s marks — belong to the Gallery or to those who have licensed their use to it.

Rights in the artworks displayed on the Site and in photographs of them belong to the artists or to the respective rights holders. Their display on the Site is for the purpose of presenting the Gallery’s activity and does not grant any right in them. Images of the works may not be copied, downloaded, published or used in any way without the consent of the rights holder.

Short text excerpts from the Site may be quoted for the purposes of journalistic coverage, criticism, research or study, subject to crediting the Gallery and in accordance with the Copyright Law, 5768–2007.

Third-party trade marks and names appearing on the Site belong to their respective owners.

If you believe that any content on the Site infringes your rights, please contact us using the details in Section 11; we will review the matter and act as required.

6. Enquiries and information you provide

When contacting us through the contact form or otherwise, please provide only the information needed for your enquiry. Sensitive information that is not required should not be sent through the Site.

Personal information you provide is handled in accordance with the Site’s privacy policy, which forms an integral part of these terms.

If you send us an unsolicited idea, proposal or creative material (including proposals for exhibitions or collaborations), you do so at your own risk. We do not undertake to keep such material confidential, and its receipt does not create any obligation on our part or entitle you to any consideration, unless otherwise agreed in writing.

7. Links and third-party content

The Site may include links to third-party websites and services, including social networks and maps. We have no control over these sites and are not responsible for their content, availability or policies. Their use is subject to their own terms and privacy policies.

8. Availability of the Site and changes

We aim for the Site to operate properly and continuously, but we do not undertake that it will be available without interruption or free of faults. Interruptions may occur for maintenance, updates or reasons beyond our control.

We may change the Site’s structure, content and the services it offers, and may discontinue its operation in whole or in part, at our discretion.

9. Liability

The Site’s content is provided as is. We endeavour to keep the information on the Site accurate and up to date, but errors, inaccuracies or details that have changed without being updated may occur.

The Gallery shall not be liable for damage resulting from reliance on information on the Site, from use of the Site or from inability to use it, except for damage caused wilfully or through gross negligence on our part, and to the extent that the law permits liability to be limited. Nothing here derogates from rights granted to you by law that cannot be contracted out of.

The Gallery is not responsible for faults arising from your own equipment, from the internet connection or from third-party services.

10. Privacy and accessibility

The Site’s privacy policy and accessibility statement are published on dedicated pages and form an integral part of these terms.

The Gallery works to improve the accessibility of both the Site and its premises. Accessibility enquiries are welcome — details appear in the accessibility statement.

12. Changes to these terms

13. Governing law and jurisdiction

These terms and the use of the Site are governed solely by the laws of the State of Israel. Exclusive jurisdiction over any matter relating to these terms or to the Site lies with the competent courts of the Tel Aviv District.

If any provision of these terms is held to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
